By booking a consultation or using our services, you agree to the following terms and conditions. Please read them carefully before proceeding.

1. Services Provided

 Mobster offers online design advice through video calls via Teams or FaceTime. Our advice is general in nature and intended to guide and assist clients with their design and renovation projects. Mobster does not provide detailed architectural, engineering, or structural drawings.

2. General Nature of Advice

 The advice provided by Mobster is based on the information and materials you provide during your consultation. It is general in nature and should not be considered as comprehensive or tailored to meet specific local regulations, codes, or standards. We recommend consulting with licensed professionals for detailed design, engineering, or construction requirements.

3. Not a Registered Architect

 Mobster is not a registered architectural practice, and our consultants are not registered architects. The advice provided is for guidance purposes only and does not replace the expertise of licensed architects, engineers, or other qualified professionals.

4. Liability and Design Outcomes

 Mobster is not responsible for the final design outcomes, construction quality, or project results arising from the advice provided during consultations. Clients are solely responsible for implementing the advice and should engage relevant professionals to ensure their project meets legal, structural, and safety standards.

5. Booking Policy

 Consultations must be booked via our website. Once a booking is confirmed, you will receive a confirmation email with the details of your appointment. Clients are responsible for ensuring they have a stable internet connection and access to Teams or FaceTime at the time of the consultation.

6. Cancellation Policy

 Cancellations or rescheduling requests must be made at least 48 hours prior to your scheduled appointment. Requests made within this timeframe can be accommodated without penalty. Cancellations made less than 48 hours before the appointment are non-refundable.

7. Refund Policy

 Refunds will only be issued under the following circumstances:

1.  If Mobster cancels the appointment due to unforeseen circumstances.

2.  If you cancel your booking at least 48 hours in advance.

3.  No refunds will be provided for cancellations made less than 48 hours before the appointment or for missed appointments. Please refer to our cancellation policy for further details.

8. Confidentiality

 Mobster respects your privacy and treats all project-related information as confidential. However, we may use anonymized data or project details for marketing or educational purposes unless expressly prohibited by the client.

9. Client Responsibilities

 To ensure an effective consultation, clients must: 

• Provide accurate and complete information about their project.

•  Share relevant documents, drawings, and images before the consultation.

•  Follow up with licensed professionals as needed.

10. Limitations of Service

 Mobster reserves the right to decline a consultation if the project scope falls outside our expertise or if the client fails to provide sufficient information.

11. Governing Law

 These terms and conditions are governed by the laws of Australia. Any disputes arising from the use of our services will be subject to the exclusive jurisdiction of the courts in Australia.

12. Consumer Guarantees

 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods or services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.

13. Electronic Communications

 By using our services, you consent to receive electronic communications from us, including appointment confirmations, invoices, and promotional materials. You can opt out of promotional communications at any time.

14. Intellectual Property

 All materials, content, and intellectual property provided during consultations remain the property of Mobster. Clients are granted a non-exclusive, non-transferable license to use these materials solely for their personal projects.

15. Force Majeure

 Mobster shall not be held liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to acts of God, internet outages, technical failures, or government restrictions.

16. Amendments

 Mobster reserves the right to amend these terms and conditions at any time without prior notice. Updated terms will be posted on our website and will apply to all future consultations.

17. Entire Agreement

 These terms and conditions constitute the entire agreement between Mobster and the client, superseding any prior agreements or understandings.
